When Should You Make a Hurricane Harvey Claim?

We have received numerous questions from people whose property was damaged during Hurricane Harvey. The number one question we have received is whether or not a claim has to be made by September 1, 2017. Here are the facts:

  • All claims made by August 31, 2017, will be governed by the “old” law.
  • All claims made on or after September 1, 2017, will be governed by the “new” law passed by the Texas Legislature this past spring.
  • The “new” law takes away some protections property owners enjoyed under the “old” law. Insurance Companies have less incentive under the “new” law to settle valid claims.

You should make a claim on or before Thursday, August 31, 2017, if possible. You need to inform your property insurance carrier(s) in writing—via email, mail, or facsimile. Make sure you date the letter and keep a copy of the letter for your records. Tell your property insurance carrier(s) that the letter/email/facsimile serves as notice of a claim due to damage suffered as a result of Hurricane Harvey.
